.:. Enchanted Bay Terms of Use .:.

Special Note: Part of becoming a member of the Enchanted Bay members
area, Creative Designs (EBCD), includes reading and agreeing to abide by
my terms of use. If you sign up, you are bound by them, whether you
actually read them or not. Periodically, the terms may change and members
will be notified using the email address associated with their membership.

If you have any questions at all, please please please feel free to contact
me and ask. I’d rather you talk to me about any questions you have now,
instead of being confronted about it later :) I know its a long page, but its
meant to protect both you and me.

.:. Membership Terms .:.

You cannot share your username and password with anyone. Anyone caught
sharing their login info will find their membership terminated and they will be
permanently banned from EBCD with no refund.

If you co-own a site (much like disbme.com or musemates.com are co-owned),
only you have the right to use the tubes, lineart, etc that are from EBCD. Each
person must have their own membership if they each want to use the items here.

You do NOT have to have a website to join. But if you do have a website, it must
not contain illegal content such as: pornography, pedophilia, illegal file sharing
info, etc. If I find that on your site, your account will be terminated with no refund.

If you have a members area, I do not require access at this time. If I ever
request access, it will only be to make sure my terms are being followed. I would
certainly pay for a membership if there is something in your members area that
I would like to use.

You must take a membership plaque from inside the members area and place
it on your site with a link to Enchanted Bay’s main url (http://www.enchantedbay.com)
within 14 days. If the plaque is not up after 14 days, you risk your account
being suspended until it is on your site and linked. I will not add the suspended
time back to your account.

There is no refund beginning the first time you log into your account. You paid
for access to EBCD. Once you’ve accessed it, you have no right to a refund.

If I find that you are not following my terms of use, you will be given a warning
once and three days to fix the problem. If it continues to be a problem after
three days or if it happens again, your membership will be terminated and
you will not be issued a refund for the remaining time. You cannot continue to
use anything from EBCD if your account is terminated by me.

If your membership expires and you do not renew, you can still use EBCD
images as long as you continue to credit me properly. Lifetime membership does
not mean my lifetime or your lifetime. It is for the lifetime of the site.

You do NOT have to purchase a profit license in order to make a profit off
what you digitally create using EBCD images. However, you DO have to purchase a
tube license in order to sell any EBCD image in a tube pack or make tubes for your
members area.

At this time, you cannot use anything from EBCD for offline commercial use (i.e.
cross stitch patterns, recipe card designs, etc). It is, however, possible that I will
offer a Commercial License in the future. You *can* use them offline if it is
for your own personal use.

.:. Tube License Terms .:.

You must purchase a tube license if you wish to tube the lineart inside EBCD
for profit - such as selling tube packs or to place inside your members
area. You can tube the lineart for your own personal use without needing
to buy a tube license.

Only members whose accounts are active (i.e. not expired) can purchase a
tube license. Your tube license is good for any and all of your sites. However,
if you co-own a site, the license is only good for the member of EBCD. Your
tube license is good forever, even if your membership expires and/or Enchanted
Bay closes its doors. However, you must keep the tube license on your site,
even if EB is gone.

If you have an active (not expired) membership to EBCD, you will receive
50% off the limited lineart packs' licenses. So if the pack itself is $10, and
with the tube license its $18, and with an as-is AND tube license, its $24,
your total costs would be: $10, $14 and $17, respectively. In the future,
I might release a lifetime limited lines as-is/tube license.

Tube licenses must be shown and linked to Enchanted Bay on the same page
that the tubes are offered, be it on an auction site, a shop on your website, or
inside your members area. There is one exception - if you are selling on an
auction site, you can make your tube license part of the sample image.

If you have any questions regarding the tube license, please contact me
and I’ll answer to the best of my ability.

.:. Lineart Terms .:.

You must color in the lineart before you offer it anywhere else, either for
profit or linkware. Lineart at EBCD cannot be tubed (to sell in tube packs or
for your members area) unless you purchase a tube license. As always, you can
tube it for your own personal use without needing to purchase the tube license.

You cannot write tutorials using the lineart inside EBCD. At this time, I do
not offer a tutorial writers license and I’m not sure I ever will.

You cannot offer any of the lineart in the EBCD area in its original form anywhere
else, such as your own members area or in outline packs. You cannot add to
a collection and then pass that collection around anywhere (Yahoo!Groups,
MSN Groups or Google Groups are a few examples).

You cannot alter any lineart inside EBCD unless it is an EB Originals piece.

Lineart from any artist other than me (Designz By Angela, disbme’s Museni, etc)
are not to be altered. EB Originals lineart can be altered in small ways (rotating
an arm, leg, moving leaves, etc), but nothing to make it unrecognizable. If
you’d like to see more sizes, poses or variety, please let me know and I’ll do
the best I can to make more EB Originals lineart using what you describe.

Please be sure to look at each page of lineart as some artists might have
different/more terms than I described above.

You must link to Enchanted Bay on each page that you use the lineart on. You can
continue to use lineart from EBCD if your membership expires and you do not renew,
but you must continue to link back to me on each page they’re used on.

.:. Tubes Terms .:.

 You can: flip it, mirror it, add it with other tubes and/or colored-in lineart, and
erase part of it if its in the way of something else you’re using.

You cannot: slice, dice, recolor, resize, create outlines from or take my tubes
and offer them anywhere else in their original form.

If you would like a tube in another pose, color or size, please let me know. If
I can, I will try to find something similar in another size to tube for you, and
I can easily do other colors than what are already provided.

You must do more than put a name on a tube and call it done. Add more
tubes. Color some lineart for yourself and use them together. The more
work you put into it, the more it feels like your own creation :)

You must link to Enchanted Bay on each page that you use my tubes on. You can
continue to use tubes from EBCD if your membership expires and you do not
renew, but you must continue to link back to me on each page they’re used on.

.:. Bases Terms .:.

You can create tubes using the base(s) for profit but only if you purchase a tube
license. You can tube the base(s) for your own personal use without needing
to purchase a license.

The base(s) must be dressed before you offer to anyone in a tube pack or
your members area. At least one “set” of clothing must be merged onto
each pose of the base you use. This is because several basemakers do
not allow the redistribution of the naked base to non-members. But bald is
fine :) If you are confused about this, please contact me and I’ll explain
or give a few examples.

You cannot alter the base(s) in any way, shape or form but be sure to read
and abide by any terms on each base’s individual page. There may be
different terms listed on that page. If you would like different poses, please
contact me and I’ll see what I can do. Several basemakers allow recoloring
of skin or eyes, but almost none allow pose alterations so I would need
to contact them first.

You must link to Enchanted Bay on each page that you use the base(s) on
(and if it is a custom base, display the base(s) logo).

You can continue to use base(s) from EBCD if your membership expires
and you do not renew, but you must continue to link back to me on each
page they’re used on (and if it is a custom base, display the base(s) logo).

If you are coloring your own bases from the outlines provided and you plan
on selling them as part of a pack or provide them to your members, please
put a bikini on them first to clothe them in some way.

.:. Miscellaneous Terms .:.

If you use any layout/webset, WordPress theme or Incredimail Letter from
Enchanted Bay, you must leave the copyright info already in place. You can,
of course, add your own copyright info but you cannot remove what is
already there.

If your membership expires and you do not renew, you can continue to use
items from Enchanted Bay as long as it is properly credited at all times (like
leaving the copyright info & links in websets and WordPress themes, and
linking sigtags, etc).
